A Moorhead man who was arrested for DUI Tuesday afternoon is in custody after kicking and  striking a North Dakota State Trooper.  The North Dakota Highway Patrol says it started around 4:30pm when a trooper encountered a vehicle in a parking lot at 2535 23rd Avenue South in Fargo.  The driver was suspected of being intoxicated and there were children in the vehicle. As 44-year-old Oscar Lee, Junior of Moorhead was being placed under arrest for DUI, Lee resisted and began kicking at officers, striking one trooper several times.  As Lee was being placed in a patrol car, he continued to resist and threatened officers.  The trooper who was kicked had to go to the hospital for treatment of minor injuries.  Lee was arrested for DUI, DUI refusal and driving under revocation, which are all misdemeanors.  He was also charged with felony resisting arrest, assault on a peace officer and terrorizing.  Lee was taken to the Cass County Jail.
