Judge Rules On Motions In Leiting Lawsuit vs Fertile

CROOKSTON, MN—A Polk County Judge has ruled on several motions in Angie Leiting’s lawsuit against her former employer, Fair Meadow Nursing Home, the City of Fertile and Fertile Mayor Dan Wilkens.

Polk County District Judge Ann Rasmusson ruled Tuesday on several motions that had been filed in April. Leiting filed suit against the City of Fertile, Mayor Dan Wilkens and the city-owned Fair Meadow Nursing Home last September after she was forced to resign from her job as nursing home administrator in June of 2023.  Leiting had asked for a temporary injunction on an order preventing her from going into Fair Meadow.  That order had been revoked last August, so the judge denied that request.  Judge Rasmusson also denied Leiting’s request to have Wilkens and all members of the Fertile City Council removed from office and that Leiting be awarded civil penalties and costs; Rasmussen called that motion premature.  Also, the defendants’ requests to dismiss charges of violating Minnesota open meetings law and inflicting emotional distress against Leiting were denied.  And the defendants’ request for a protective order was denied–with Judge Rasmusson saying that matter requires further discussion. 

Next up in this case is a status conference on August 2, followed by a scheduling conference September 13.
