Minnesota red flag gun laws takes effect today
R&J News continues to highlight some of the new laws that will be taking effect today and one that will start being enforced today is the protection order red flag gun law. This new law will allow Minnesotans to ask courts to prevent individuals from owning a gun if they believe the individual is a danger to themselves or someone else.
This new law allows judges to grant two two different kinds of orders with those being an emergency order that would last for 14 days, and an extreme risk order that can last up to one year.
If enough evidence is brought to a court and they grant an order, individuals will have up to 24 to surrender all firearms in their possession to a licensed gun dealer or a law enforcement agency. If an individual fails to do so law enforcement agencies will be forced to execute search warrants and take the individuals guns forcefully.
The new law has received some push back from law enforcement agencies who have had enforcement concerns especially when individuals fail to turn over their weapons willingly. Minnesota law enforcement agencies continue to work with the state while these concerns and questions are figured out and answered.
