Hearing June 5 In Leiting Lawsuit Vs Fertile

Here’s an update to a story R&J News has been following.  A hearing has been scheduled for June 5 in Polk County Court to determine if a summary judgement should be issued in Angie Leiting’s lawsuit against the City of Fertile, former Mayor Dan Wilkens and the city-owned Fair Meadow Nursing Home.  You’ll remember Leiting resigned under pressure in June 2023.  She is asking that the two remaining City Council members from that time period–Mary Kiefer and Amanda Bosman–be removed from office….with the possibility of City Administrator Lisa Liden also being removed from office.  Leiting is also asking for awarding of civil penalties, costs and attorney fees.  Her motion shows that it has been proven that the Fertile City Council violated Minnesota’s open meeting law five times in 2023 to discuss Leiting and removing her from her job.

The City of Fertile’s attorney has also filed for a summary judgment dismissing the case, claiming there was no intentional violation of the open meeting law.

A jury trial is scheduled for October 27.  Again, this hearing on a summary judgment is scheduled for June 5 in Crookston.
