Hearing Set For Leiting Lawsuit vs. City of Fertile
Here’s an update to a story R&J News has been following. A hearing on former Fair Meadow Nursing Home administrator Angie Leiting’s lawsuit against the City of Fertile has been scheduled for Friday, February 23 in Polk County. You’ll remember Leiting was forced to resign her job by the Fertile City Council. The City of Fertile owns Fair Meadow Nursing Home. Leiting has asked for a summary judgment against the City of Fertile and Mayor Dan Wilkens for violations of Minnesota’s open meeting law. This past October, the Minnesota Department of Administration issued an advisory opinion that the Fertile City Council violated the open meeting law four times in 2023. The Department of Administration also ruled that the City didn’t respond appropriately to a data request in June, when it did not respond within ten business days.
The City of Fertile’s attorney for this case, Kendra Olson, has filed a motion to dismiss Leiting’s claim against the City for violating the open meeting law, as well as Leiting’s claim of negligent infliction of emotional distress. The hearing will be held via Zoom on Friday, February 23.
